Terms & Conditions
of Service

The below Terms and Conditions of Service apply to services provided by Nathalie's Happy Paws Pet Retreat LLC and any of its employees to any of its customers.

1. Drop-off and pick-up dates/times:  Pets must be dropped off and picked up on the dates and times listed on the invoice provided.  Any changes to these may result in additional charges.

2. Dog Boarding: 

  • Nightly rates are based on 24-hour time period from drop-off to pick-up. 

  • Extended care rates may apply for each pet if the end time on the final day of the stay is more than 1 hour later than the start time on the first day of the stay. 

  • Extended care rate is listed on the invoice. 

  • Total for extended care is not to exceed daily rate shown on this invoice. 

 

3. Dog Daycare:

  • Rates are based on 4 hours or 8 hours from drop-off to pick-up time. 

  • Any daycare booking longer than 8 hours will be charged overnight boarding rates.

 

4. Cat Boarding/Daycare:  Rates are based on 24-hour time period from drop-off to pick-up. 

 

5. Pet Owner is responsible for providing the following to Nathalie’s Happy Paws Pet Retreat for any pets in its care:

  • Pet food for the duration of the stay + 1 day (in case of delays)

  • Collar and leash; harness if required

  • Medications required

  • Vaccination records for each pet

  • Completed care questionnaire

 

6. Nathalie’s Happy Paws Pet Retreat LLC agrees to exercise due and reasonable care to board the Pet of the Owner.  Nathalie’s Happy Paws Pet Retreat LLC does not assume and shall not be held responsible for any liability with respect to the Pet listed in this agreement, of any kind, character, or nature whatsoever, arising out of or from the boarding of this Pet, or any damages which may accrue from any other cause whatsoever, including loss by fire, theft, running away, injury to persons, animals or property, unavoidable causes, or death or injury to any other animal caused by the within named Pet during the term of this contract, whether this Pet be on the premises of Nathalie’s Happy Paws Pet Retreat LLC or not.  Pet Owner hereby agrees to be and is solely responsible for an and all acts of behavior of said Dog at any time within the term and time of the contract.  In no case shall Nathalie’s Happy Paws Pet Retreat LLC be in any way liable or responsible.

 

7. Under no circumstances shall Nathalie’s Happy Paws Pet Retreat LLC be liable to the Pet Owner or any third party in an amount exceeding the sum of One Hundred Dollars ($100.00).  Pet Owner agrees not to claim any damages against Nathalie’s Happy Paws Pet Retreat LLC or Nathalie Chomel of any nature whatsoever, either by way of contract, equity, negligence or otherwise, in excess of said sum.

 

8. Owner specifically covenants, warrants and represents the following:

  • He/She is the sole owner of said Pet;

  • There is not now any lien or mortgage against said animal; and

  • The animal has not been exposed to distemper or rabies within the last thirty (30) days.

  • The animal is under flea, tick, and heartworm treatment.

9. If the animal becomes ill, or Nathalie’s Happy Paws Pet Retreat LLC suspects animal is ill, the Pet Owner shall be notified at once or such attempt shall be made to so notify the Pet Owner.  Pet Owner shall arrange for collection of the animal, if possible, or make other arrangements with Nathalie’s Happy Paws Pet Retreat LLC.  If Pet Owner does not immediately inform Nathalie’s Happy Paws Pet Retreat LLC regarding measures to be taken or if the state of the Pet’s health requires a quick action, the Pet Owner give the right to call a veterinarian or to administer medicine or to give advisable attention within the discretion of Nathalie’s Happy Paws Pet Retreat LLC, and such expenses being reasonable in amount shall be promptly paid by the Pet Owner to the relevant party (Nathalie’s Happy Paws Pet Retreat LLC, a veterinarian, or other).

 

10. Claims: Unless Pet Owner files with Nathalie’s Happy Paws Pet Retreat LLC, within thirty days from date the animal is removed from Nathalie’s Happy Paws Pet Retreat LLC, a written demand for any claimed injury or damages resulting from the boarding of said Pet under this contract, said Pet Owner shall and does hereby waive any and all rights which he may have against Nathalie’s Happy Paws Pet Retreat LLC or its owner for any liability arising under this contract, for damages, or otherwise.

 

11. The animal may be taken off premises by Nathalie’s Happy Paws Pet Retreat LLC without the consent of the Owner.

 

12. Payments:  All payments are due in full no later than at drop-off date/time.  Pet Owner personally guarantees full payment of the boarding fees.  Interest charged on an overdue bill shall be at the maximum allowed by law, but not to exceed 1.5% per month, compounded daily.

 

13. Cancellations:

At Nathalie’s Happy Paws Pet Retreat, we understand that plans can change. To ensure fairness and provide the best experience for all clients and their pets, we have established the following Cancellation & Refund Policy.

A. General Cancellation Policy

We kindly ask that all clients notify us as soon as possible if they need to cancel or modify a reservation.  Cancellations made anytime before the scheduled drop-off time:

- No cancellation fee. Any deposit or prepaid amount will be refunded in full or applied as credit toward a future stay.  Prepaid amounts will be refunded or credited.

- Nathalie’s Happy Paws Pet Retreat LLC reserves the right to cancel any booking that is not paid in full at date and time of pet drop-off.   Any changes to bookings during the pets’ stay which result in additional charges are payable in full prior to or at pet’s pickup.  An updated invoice will be provided should a stay be extended.

B. Daycare Cancellations

Packages (5-day, 10-day, monthly unlimited):

- Non-refundable once purchased

- Can be transferred to another pet owner with approval

- Must be used within the designated period at time of purchased.

C. Early Pickup / Shortened Stays

If you choose to pick up your pet earlier than originally scheduled:

- The full length of the original booking will still be charged.

- No partial refunds are provided for unused nights during boarding stays.

D. Refund Method

Approved refunds will be issued to the original form of payment unless otherwise requested and approved. Refunds typically take up to 10 business days depending on your bank or payment processor.

E. Business-Initiated Cancellations

In rare circumstances, we may need to cancel a reservation (e.g., illness, unsafe conditions, emergencies).
If this occurs:

- You will receive a full refund of any deposits or prepaid amounts.

- We will assist in rescheduling whenever possible.

F. How to Cancel or Modify a Reservation

G. Agreement to Policy

By booking services with Nathalie’s Happy Paws Pet Retreat, you acknowledge that you have read, understood, and agree to this Cancellation & Refund Policy.

 

14. Vaccinations: Owner hereby provides proof of current rabies immunization, distemper, hepatitis, leptospirosis and any other vaccinations as required by law and by Nathalie’s Happy Paws Pet Retreat LLC.

 

15. Photo & Media Use / Media Release Authorization
The Client hereby grants Happy Paws Pet Retreat LLC the right to photograph and/or record their pet during services and to use such images or recordings in all forms of media for promotional, advertising, and business purposes. This authorization is granted without compensation. The Client may revoke this permission at any time by submitting a written request; however, revocation will not apply to materials already published or in production.

16. Severability:  The invalidity of any portion of this Agreement will not and shall not be deemed to affect the validity of any other provision.  If any provision of this Agreement is held to be invalid, the parties agree that the remaining provisions shall be deemed to be in full force and effect as if they had been executed by both parties subsequent to the expungement of the invalid provision.

17. No waiver: The failure of either party to this Agreement to insist upon the performance of any of the terms and conditions of this Agreement, or the waiver of any breach of any of the terms and conditions of this Agreement, shall not be construed as subsequently waiving any such terms and conditions, but the same shall continue and remain in full force and effect as if no such forbearance or waiver had occurred.

18. Governing Law: This agreement shall be governed by, construed, and enforced in accordance with the laws of the State of Texas.

19. Notices: Any notice provided for or concerning this Agreement shall be in writing and shall be deemed sufficiently given when sent by certified or registered mail if sent to the respective address of each party as set forth at the beginning of this agreement.

20. Mandatory Arbitration:  Any dispute under this Agreement shall be required to be resolved by binding arbitration of the partes hereto.  If the parties cannot agree on an arbitration, each party shall select one arbitrator and both arbitrators shall then select a third.  The third arbitrator so selected shall arbitrate said dispute.  The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect.

21. Assignment of Rights: The rights of each party under this Agreement are personal to that party and may not be assigned or transferred to any other person, firm, corporation, or other entity without prior, express, and written consent of the other party.

22. In this contract, any reference to a party includes that party’s heirs, executors, administrators, successors, and assigns, singular includes plural and masculine include feminine or other.

23. Agreement to Terms & Conditions of Service

By booking services with Nathalie’s Happy Paws Pet Retreat, you acknowledge that you have read, understood, and agree to these Terms & Conditions of Service.
